In light of ongoing concerns and confusion resulting from federal actions on immigration enforcement, we want to take this opportunity to again reaffirm our district’s commitment to ensuring a safe and supportive learning environment for all members of our community. While there have been no major federal policy changes directly impacting our district since last week's update, it is important that students, faculty, and staff know that the district continues to actively seek ways to support our campus community. The district is in the process of incorporating feedback for the adoption of Board Policy 3415: Immigration Enforcement Activities, which outlines the district’s procedures in the event of immigration enforcement actions on our campuses.
Key Protections Under Board Policy 3415
- Restricted Access: Immigration enforcement officers are not permitted in non-public areas of our campuses unless they provide a judicial warrant or demonstrate exigent circumstances.
- Reporting Protocols: Any district personnel who become aware of immigration enforcement activities or requests for access must immediately notify the Office of the Chancellor or the Office of the President (depending on personnel’s work location). If after hours, campus safety personnel should be contacted.
- Legal Review: The district will review any warrant, court order, or subpoena before responding to ensure compliance with legal requirements and to protect student and employee rights.
- Student Support: If a student is detained or unable to continue their education due to an immigration action, the district will make reasonable efforts to assist in preserving their eligibility for financial aid, re-enrollment, and other academic support.
- Confidentiality: Students’ and employees’ personal information, including immigration status, will not be disclosed unless required by federal or state law.
Support and Resources
Our district remains committed to upholding the rights and safety of all individuals, regardless of their immigration status. We continue to maintain a list of resources available to assist students, faculty, classified professionals, and administrators who may need immigration-related support.
- FREE LEGAL SERVICES: The Higher Education Immigration Legal Services Program provides a wide range of free immigration legal services to undocumented and mixed status students, faculty and staff on California community college campuses. More information at FindYourAlly.com
- MENTAL HEALTH SUPPORT: If you feel anxious and overwhelmed, seek free mental health support to help you navigate difficult times. Chabot College Services | Las Positas College Services
- Across our district, El Centro, the Dream Center, the Cultural Community Center, the New Student Support Center and other student support services are available to provide resources, legal guidance, and safe spaces for students impacted by these policies
Additionally, we encourage all students, faculty, and staff to familiarize themselves with Board Policy 3415, which serves as a critical framework for how our district responds to immigration enforcement matters.
We will continue to monitor developments at the federal level and provide updates as necessary. If you have any questions or concerns, please do not hesitate to reach out to your college administration or the Chancellor’s Office.
In Solidarity,
President Dyrell Foster, Las Positas College
